We operate the mobile application spark (the 'App'), as well as any other related products and services that refer or link to these legal terms (the 'Legal Terms') (collectively, the 'Services').

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the 'Last updated' date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application refers to Spark, the software program provided by the Company.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Mind Purpose Leadership Private Limited, Faridabad, India OR Spark which is the intellectual property of Mind Purpose Leadership Private Limited.
  • Country refers to: India
  • Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
  • Applicant means any individual or entity that applies to be part of our coach network through our website www.sparkapp.in (the “site”)
  • Coach means any individual who contracts with us to provide the users of our platform with their coaching services.

Collecting and Using Your Personal Data

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and Last name
  • Phone number
  • Gender
  • Job title
  • Industry
  • Usage Data

We may request that you furnish us with data aimed at enhancing your experience on the Platform. This could entail the following requests to our Users:

  • Participating in surveys to assist us in finding a Coach who closely aligns with your coaching objectives.
  • Undertaking an assessment designed to provide you with valuable insights into your strengths and weaknesses. This assessment will involve a series of questions covering six main areas of life namely Career, Relationships, Spirituality, Physical wellbeing, Mental wellbeing, and Financial wellbeing.
  • Sharing your feedback on your coaching sessions and overall Platform experience.
Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Data From Our Website

If you are a visitor to our public website, www.sparkapp.in, we will collect certain information. We use cookies and similar technologies (e.g., web beacons, pixels and ad tags) to collect data (e.g., device IDs) from our public Site to recognize you and your device(s) on, off and across different services and devices where you have engaged with our Site. We also allow third parties to use cookies as the Cookie Policy describes. We may also collect (or rely on others who collect) data about your device where you have not engaged with our Site (e.g., ad ID, IP address, operating system and browser data) so we can provide our Visitors with a better user experience. You can opt out from our use of data from cookies and similar technologies that track your behavior on the sites of others for ad targeting and other ad-related purposes.

Data From Applicants

We collect information if you apply for a job (“Applicant”) with Spark. We will need to collect certain personal information from you in order to process your application, such as your name, email address, phone number, location, and work history. This information is used to evaluate your experience and communicate with you.

Spark does work with several third party vendors to assist in the application process and where those systems will have access to your personal information Speak will provide the appropriate disclosures. If any of these systems will require highly sensitive personal information or request session recordings, you will be notified at that time.

Data from coaches

If you are a Coach, we collect data when you submit an inquiry to provide coaching services for us, when you use the Platform, when you request technical support, and when you otherwise initiate communication with us.

We never require Coaches to provide us any sensitive Personal Data (e.g. financial data), although we may request demographic or other personal data from Coaches when we are testing a new tool or feature, staffing a specific program for customers, or conducting research studies. The type of demographic or personal data we may request may include gender, race, ethnicity, specialized skills such as ASL, or for federal programs, your citizenship. When asking for demographic data, Spark does so because we believe it will improve the services for our Users and Coaches; however, providing such personal information shall remain optional.

We may ask for your consent as a Coach to record your coaching session for training, research, or additional purposes as further described in Section 2.6, in which case we may collect data capturing your image, voice, and/or a transcript of recording in order to conduct analysis for the betterment of the User, also known as our Members, and your future coaching sessions. Spark understands video recordings may capture sensitive personal information; therefore where possible, Spark will minimize the amount of personal data being accessed by analyzing the recordings after de-identification or conducting analysis on the transcript rather than the full video. We discuss this further within Section 2.6 below.

As a Coach, we may ask you to provide us data to improve your experience on the Platform. For example, we may ask Coaches:

  • to review your coaching and Platform experience.
  • personal preferences within your Coach profile, such as preferred pronouns and preferred language

In all circumstances, your decision to provide Spark with Personal Data has no impact on your role as a Coach, and you may withdraw consent at any time by emailing. support@mindpurpose.in.

Payment Data

We may collect data necessary to process your payment if you make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All payment data is stored by Razorpay. You may find their privacy notice link(s) here: https://razorpay.com/privacy/.

Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

  • Pictures and other information from your Device's camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.
